Terms of Service

In these terms, the following definitions apply:

Platform

means the Truer Therapy website and all related services.

We, us, our

means Truer Therapy LLC.

Therapist

means a licensed mental health professional who has created a profile on the platform to offer services.

Client

means an individual who uses the platform to find and connect with therapists.

Consult

means a free 15-minute introductory video or phone session between a client and therapist.

Session

means a paid therapy session booked through the platform.

Match

means a pairing between a client and therapist based on the intake questionnaire results.

Founding Member

means a therapist who joined during the founding campaign and received a lifetime discounted subscription rate.

To use Truer Therapy, you must:

• Be at least 18 years of age. In jurisdictions where minors aged 16 and 17 may consent to mental health services, they may use the platform with parent or guardian consent.
• Provide accurate and complete information during registration.
• Have the legal capacity to enter into these terms under your jurisdiction.
• Therapists must hold an active, unrestricted license to practice in their jurisdiction.

Truer Therapy is currently available in the United States including Puerto Rico and US territories. We plan to expand to other countries in the future. If you are accessing the platform from outside the United States, you are responsible for ensuring your use complies with local laws.

You are responsible for maintaining the security and confidentiality of your account credentials. You must not share your account with others or allow unauthorized access. You agree to notify us immediately at anchored@truer-therapy.com if you suspect any unauthorized use of your account. We are not liable for any losses resulting from unauthorized access to your account due to your failure to protect your credentials.

If you are using the platform as a therapist, you represent and warrant that:

• You hold an active, unrestricted license to practice in your jurisdiction and will maintain it throughout your use of the platform.
• The license information you provide is accurate and current.
• You will update your license information if it changes, expires, or is revoked.
• You will comply with all applicable laws, regulations, and professional ethics codes in your jurisdiction.
• You will provide services within your scope of practice and competence.
• You are solely responsible for the therapy services you provide to clients. Truer Therapy does not direct, control, or supervise your clinical work.
• You will maintain appropriate professional liability insurance if required by your jurisdiction.
• You will not use the platform to solicit clients outside of the platform or circumvent platform fees.
• You will respond to client consult requests and messages in a timely and professional manner.
• You are responsible for your own tax obligations related to income earned through therapy sessions.

Truer Therapy facilitates the connection between clients and therapists but does not employ, contract with, or supervise therapists. Therapists are independent practitioners solely responsible for their professional conduct and services.

If you are using the platform as a client, you agree that:

• You will provide accurate information during the intake questionnaire to enable appropriate matching.
• You understand that Truer Therapy is a matching platform and does not provide medical advice, diagnosis, or treatment.
• You are solely responsible for your decision to work with any therapist matched to you.
• You will attend scheduled consultations and sessions on time or cancel with reasonable notice.
• You will treat therapists and platform staff with respect.
• You will not use the platform in a way that is fraudulent, abusive, or harmful to others.
• You understand that the free consultation is not a therapy session and is limited to 15 minutes.
• You will not record consultations or sessions without the consent of the other party.
• You will pay any agreed session fees directly to your therapist unless otherwise arranged.

Truer Therapy provides the following services:

• A matching algorithm that pairs clients with therapists based on intake questionnaire responses.
• A scheduling tool for booking free consultations and paid sessions.
• A communication system for clients and therapists to exchange messages.
• A profile system for therapists to display their professional information.
• A subscription system for therapist platform membership.

Truer Therapy does not provide:

• Medical advice, diagnosis, or treatment.
• Crisis intervention or emergency services.
• Guarantee that a match will result in a successful therapeutic relationship.
• Verification of therapist background or criminal history beyond license verification.
• Storage of clinical records, therapy notes, or treatment plans.

If you are experiencing a mental health crisis or emergency, contact your local emergency services immediately. In the United States, call or text 988 to reach the Suicide and Crisis Lifeline. In the United Kingdom, call 111. In Ireland, call 112 or 999. In Canada, call 911. In Australia, call 000. In New Zealand, call 111. In Singapore, call 995.

Therapists subscribe to Truer Therapy on a monthly basis. Subscription rates are:

• Standard rate: $49 per month.
• Founding member rates: Wave 1 at $24.50 per month, Wave 2 at $29.40 per month, Wave 3 at $34.30 per month.

All plans are billed monthly through Stripe. The first month is free for all founding members. Subscriptions auto-renew monthly unless cancelled. You can cancel anytime from your therapist dashboard. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods. If you cancel and reactivate later as a founding member, your discounted rate is preserved and tied to your license number. We may change the standard subscription rate for new therapists at any time. Existing subscribers will be notified at least 30 days before any rate change and the new rate will apply from the next billing cycle after notification.

Founding member discounts are subject to the following terms:

• There are 1,000 founding member spots total across three waves.
• Wave 1 includes the first 200 verified therapists at 50% off for life.
• Wave 2 includes the next 300 verified therapists at 40% off for life.
• Wave 3 includes the final 500 verified therapists at 30% off for life.
• Your wave is determined by the order in which your profile is completed and verified, not by when you register.
• The founding discount is tied to your professional license number. If you cancel your subscription and return later, your founding discount is preserved as long as you use the same license number.
• If your license is revoked or expired, your founding discount is suspended until your license is reinstated.
• Founding member discounts are non-transferable to other therapists or license numbers.
• Once all 1,000 spots are filled, no additional founding spots will be created. New therapists after that point join at the standard rate.

Founding members receive the following benefits:

• Founding Member badge on profile.
• Priority placement in client matching results.
• Featured in the founding therapists section.
• Early access to new platform features.
• A direct line to the founders for feedback and support.

Therapy session payments are arranged directly between clients and therapists. Truer Therapy does not process session payments unless the therapist opts in to use our integrated payment system. If integrated payments are used, Stripe processes all transactions and Stripe fees apply. Truer Therapy does not take a percentage of session fees. The platform subscription fee is the only fee therapists pay to Truer Therapy. Clients do not pay any platform fees. Both parties are responsible for their own tax obligations. If a payment dispute arises, you must contact the other party first. Truer Therapy is not responsible for resolving payment disputes between clients and therapists.

Truer Therapy owns all rights to the platform, including its name, logo, design, matching algorithm, and content created by us. Therapists retain ownership of their profile content, including bio, photo, and intro video. By uploading content to the platform, you grant Truer Therapy a license to display it on the platform and in promotional materials related to the platform. You may not use the Truer Therapy name, logo, or branding without our written permission. You may not copy, modify, or distribute platform content without permission. If you believe your intellectual property has been used on the platform without permission, contact us at anchored@truer-therapy.com.

You agree not to:

• Provide false, misleading, or inaccurate information.
• Use the platform to harass, abuse, threaten, or defraud others.
• Solicit clients or therapists outside the platform to avoid platform fees.
• Share account credentials with others.
• Impersonate another person or professional.
• Use another therapist license number to obtain founding member discounts.
• Record sessions without consent.
• Use the platform for any illegal activity.
• Attempt to access unauthorized platform data or systems.
• Send spam or unsolicited messages through the platform.
• Misrepresent credentials, licensing, or professional qualifications.

We reserve the right to suspend or terminate accounts that violate these terms.

Your use of the platform is also governed by our Privacy Policy, which is incorporated into these terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. Key points: We do not sell your personal information. Client questionnaire responses are used only for matching and are not displayed publicly. Therapist profile information is displayed publicly to clients. We follow HIPAA-aligned security practices in the United States and comply with GDPR in the United Kingdom and Ireland, PIPEDA in Canada, the Privacy Act in Australia and New Zealand, and PDPA in Singapore.

Truer Therapy is provided on an as-is and as-available basis. We make no warranties, express or implied, about the platform or its services. We do not guarantee that:

• A match will result in a successful therapeutic relationship.
• Therapists will be available at all times.
• The platform will be uninterrupted, secure, or error-free.
• Client questionnaire responses will produce perfect or optimal matches.

We are not a healthcare provider and do not provide medical advice, diagnosis, or treatment. Any reliance on information provided through the platform is at your own risk. Therapy outcomes depend on factors outside our control, including the therapist-client relationship and client circumstances.

To the maximum extent permitted by law, Truer Therapy LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim arising from these terms or your use of the platform shall not exceed the amount you have paid us in the 12 months preceding the claim, or $100 if you have not paid us anything. This limitation applies to all claims, including breach of contract, tort including negligence, and any other legal theory. We are not liable for the conduct of therapists or clients on the platform, including the quality of therapy services provided. We are not liable for any outcomes resulting from therapy sessions or consultations.

You agree to indemnify and hold harmless Truer Therapy LLC, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses including reasonable attorney fees arising from:

• Your use of the platform.
• Your violation of these terms.
• Your violation of any law or third-party rights.
• Your conduct as a therapist, including the services you provide.
• Your conduct as a client, including failure to pay session fees or abusive behavior.

We reserve the right to assume exclusive defense of any claim for which we are entitled to indemnification, and you will not settle any claim without our consent.

These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles, for users in the United States and its territories. For users in other countries, these terms are governed by the laws of your jurisdiction to the extent required by local law, with California law as the governing law for all other matters.

Dispute Resolution

Any dispute arising from these terms or your use of the platform will first be attempted to be resolved through informal negotiation. You agree to contact us at anchored@truer-therapy.com and attempt to resolve the dispute for at least 30 days before initiating formal proceedings. If the dispute cannot be resolved informally, it will be resolved through binding arbitration administered by the American Arbitration Association for US users, or through the appropriate dispute resolution body in your jurisdiction for users outside the US. Arbitration will be conducted in San Francisco, California for US users. The arbitrator's decision is final and binding. You waive your right to participate in a class action lawsuit or class-wide arbitration.

You can cancel your account at any time from your dashboard settings or by contacting us at anchored@truer-therapy.com. We may suspend or terminate your account if:

• You violate these terms.
• Your license is revoked, expired, or suspended for therapists.
• You engage in prohibited conduct.
• Your account is inactive for more than 12 months.
• We are required to do so by law.

Upon termination:

• Therapist profiles will be removed from the directory and search results.
• Pending consultations will be cancelled and clients notified.
• Match records will be retained but marked as expired.
• Founding member discounts are preserved if you return with the same license number.
• Data will be retained according to our Privacy Policy retention schedule.

We may update these Terms of Service from time to time. When we make material changes, we will notify you by email at least 30 days before the changes take effect. We will also update the Last Updated date at the top of this page. Your continued use of the platform after the effective date constitutes acceptance of the updated terms. If you do not agree to the updated terms, you may cancel your account before the effective date.
